MAG Ireland along with other constituent groups within FEMA have successfully opposed the inclusion of American made or assembled motorcycles on the list of goods subject to heavy tariffs to be imposed by the EU Commission. The measure would have resulted in a major price increase on Harley Davidson motorcycles imported into Europe together with many Japanese marque machines which are assembled in the United States, pricing them out of reach of many European purchasers.
Thousands of leaflets were distributed to members through Roadrunner, by local groups and through bike shops. The flyers seem to have generated a significant response among candidates – in fact, one candidate had heard about the flyer from another candidate and contacted us to be sent one! We hope that most of you availed of the opportunity to put these questions to your candidates. The new government comes into power with an increased awareness of issues concerning motorcyclists as a result of your efforts which can only help us to achieve our goals.
A letter containing the questionnaire issued to candidates during the week prior to the GE. Several candidates responded indicating a favourable response to all/most of the issues raised and suggested meeting with us after the election. Of these candidates, I will be contacting those unelected to thank them for their response and I will arrange meetings with successful candidates over the coming weeks.
The Irish Times website hosted an online Q & A session with the leaders of the political parties to which I submitted the BAV questions, below find answers from Mary Harney and from Trevor Sargent. The other party leaders did not respond.
Mary Harney: “I recognise that responsible motorcycle routes is an environmental and sustainable form of transport in cites where traffic is acute. As regards insurance we will implement the recommendations in the MIAB report on the cost of claims and functioning of the insurance market. For the first time we have placed the consumer interest in financial regulation at the heart of the new IFSRA where there will be a statutory officer with responsibility for consumer protection.”
Trevor Sargent: “Time does not allow a very long answer but motorcycles and scooters have a crucial role to play in tackling traffic congestion. The use of bus lanes for motorcycles would not be a problem if cyclists had a separate cycle-way. We support MAG in calling for a removal of VAT from safety equipment such as helmets. Likewise we support secure parking for both motorcycles and other bicycles.”
The Minister of State to replace Mr Bobby Molloy has not yet been announced. When he/she is appointed I will be contacting him/her on this issue. In the meantime, I will be writing to Martin Cullen, T.D., the new Minister for the Environment & Local Government outlining the case for access to bus lanes by motorcyclists.
I have been in touch with Antonio Perlot of FEMA who will assist us with this campaign at European level. FEMA’s expertise in lobbying MEPs will be invaluable in furthering our efforts to bring Ireland into line with most of the other member states. At the moment, Spain is the only other member state which does not allow a Direct Access route to an unrestricted A licence, while Germany differs from others in allowing DA at age 25 instead of at 21 years.
I have written to the National Safety Council requesting a meeting to discuss the recent proposal for a register of driving instructors with a view to the inclusion of MAG/IRTA on the committee to oversee the implementation of such a register.
In a recent letter, EU Commissioner de Palacio has said that the effects on the relative conspicuity on other road users as a result of DRL use on cars will be the subject of a study in 2002. The commissioning of the study is a direct result of lobbying by MAG Ireland and other motorcyclists’ organisations. The Commissioner thanks us for our contribution to the debate.
The weighty and substantial MIAB report was delivered to me some weeks ago. Due to pressures of time and the huge amount of information in the report, my ambitious plans for a complete report on same have had to be deferred. However, the annotated (condensed) version of the report contains among its 67 recommendations a call for the establishment of a Motor Policyholders Protection Fund using the motor insurance levy collected up to 1993. This recommendation is of particular relevance to motorcyclists in the wake of the collapse of Independent Insurance. The government consistently refused to involve itself in this issue and it was left to MAG Ireland to advise thousands of Irish bikers of their rights.
Irish motorcyclists, like many other Irish motorists, are incensed by successive governments’ failures to address the issues of profiteering by insurance companies, the high costs of claims, delays in processing claims and the lack of properly funded training initiatives to improve road safety and reduce accidents.
Motorcyclists in Ireland are particularly affected by the lack of competition within the insurance industry, with only one insurance company offering cover on these machines until Carole Nash Insurance came into the Irish market in 1997. With only two companies to go to and with Carole Nash catering to the over-23 market exclusively, Hibernian have an effective monopoly on providing insurance to the younger rider. In the light of the Report’s findings on the profits made by insurance companies on policies provided to younger motorists, the assertion by insurers that this sector of the market is unprofitable is no longer tenable.
The establishment of a Statutory Office of Insurance Ombudsman will greatly assist motorcyclists in dealing with insurance companies and will ensure the compliance of insurers with current and future legislation and the IIF voluntary Code of Conduct proposed in the Report.
The three-month deadline for the report of the Implementation Board is also welcome. We would hope to see the recommendations of the MIAB properly implemented without delay and a fair and equitable system established.
The UK Chancellor of the Exchequer announced on 17th April that the tax rates and taxation bands would be restructured, cutting the rates of tax in all but the smallest capacity category. The bands and rates are similar to those proposed by MAG at last year’s meeting with the DoE and will lend weight to our argument for a comparable restructuring of the taxation bands here.
I have written to the Department informing them of the UK changes and reiterating our position on the existing Irish system.
I met with Michael Kennedy of the NRA on Thursday 13th June. The meeting provided a useful opportunity to present our case in a cohesive manner. In response to the difficulties experienced by motorcyclists using the West and East Link bridges, i.e. Eazypass system, barriers unsafe for motorcyclists etc., Mr Kennedy advised me that these were operational issues and thus were outside the remit of NRA. NTR, as operators of the Toll Plazas are responsible for problems with the day-to-day running of the toll bridges.
Mr Kennedy was quite definite that Hard Tolling would not be dropped in favour of Shadow Tolling, despite the benefits to road users as outlined by myself and the fact that the system works well in the 8 UK schemes and 1 Finnish scheme I drew to his attention. The position of the NRA on this subject seems intractable. They argue that Hard Tolling brings in “hard cash” where Shadow Tolling doesn’t. This argument is fallacious however, as whether you remove cash from the user’s pocket at the toll booth or the government maintains or raises tax levels to pay tolled road operators makes no appreciable difference in the end.
Mr Kennedy said that motorists were willing to pay for shorter journey times. I argued that long traffic queues at both toll plazas and approach roads were not shortening journey times but were in fact main factors in traffic gridlock on the M50, N7, N4 and other tributory roads. I questioned the validity of the NRA’s recent poll on this issue where the sample group was so small (1200 approx) and of that sample, only 750 (approx) were motorists and therefore likely to be affected by paying tolls.
I drew Mr Kennedy’s attention to the exemption of motorcycles from charges on the Eastlink Bridge and to the dropping of charges for motorcycles on the Dartford Tunnel by April 2003
I put it to him that in view of the negligible revenue generated from the tolling of motorcycles, it was more cost-effective to exempt them from charges than to provide proper facilities in which to charge them – i.e. separate lanes to allow for the longer time taken by motorcyclists to pay by cash; safer barriers to avoid injuries to motorcylists; redesign of the Eazypass system for use by motorcyclists.
I cited the diversion of motorcycles onto alternative routes from the safer, tolled roads due to the inconvenience and expense caused to motorcyclists when attempting to use toll booths as a safety concern due to the vulnerability of motorcycles to poorer road surfaces, the dangers of encountering agricultural machinery etc. I pointed out that these alternative routes would be less well maintained as focus shifted to the main tolled route.
I informed Mr Kennedy of the benefits of encouraging the use of scooters and motorcycles to reduce pollution and alleviate traffic congestion. Mr Kennedy answered that the proposed tolled routes were inter-urban rather than urban in nature. I responded that it was not unusual for people working in Dublin to commute from Kinnegad, Drogheda and further away and that towns such as these were becoming in effect dormer towns for Dublin.
Mr Kennedy advised me that our best approach might be to present the independent Inspector at future Oral Hearings with a document stating our case in detail. If we can persuade the Inspector of the merit of our case then he/she could recommend to the Board of the NRA that motorcycles be exempted from charges on future schemes. Another avenue he suggested was a submission when the Bye Laws for a Scheme are being considered. As regards existing toll schemes, he was not optimistic on gaining exemptions from these charges.

NORGESTREFFET is
Norway's largest motorcycle rally, with some 2-3000 participants. The rally is
organised by NMCU (MAG in Norway) in cooperation with a member club. This
year's rally is hosted by Sandnes MC, a club from the south-western part of
Norway. NORGESTREFFET 2002 will be held in Sandnes, near the city of Stavanger,

Before ringing the MAG
office please consider if it wouldn't be better ringing your MAG
representative, the DOE Driver Testing Section, your local motorcycle dealer or
the Yellow Pages first. The MAG Office will help with your queries where
possible but doing so reduces the time available to administer MAG for
everyone's benefit.

Bank Standing orders are by far the easiest
way for MAG members to pay their subscription. They are also much cheaper and
quicker for the MAG office to process.
MAG is now passing these savings onto its members. As well as offering
three months free membership for members who take out a standing order, MAG has
decided to introduce a “fiver back” promotion - any MAG member who gets a
friend to sign up for a standing order will get a fiver (€6.35) back in cash.
This means that if all
the members of a club of twenty people decide to support MAG with bank standing
orders and name their treasurer as recruiter then the club will receive one
hundred pounds (128 Euro) from MAG.
